LPA 49 – Damage Caused by Water from Another’s Land

In April 2010, New Civil Engineer magazine reported on a rail disaster in Italy in which 9 people died when a train was derailed by a landslide possibly triggered by failure of an irrigation pipe on adjacent land. This LPA addresses a number of scenarios where damage to a neighbour’s land may be caused by escaping water and considers the potential liability.
