This Loss Prevention Alert is to be read in conjunction with Loss Prevention Alert 27 which gives a background to the regulations in force.

The Control of Asbestos Regulations 2012 came into force on 6 April 2012 and replaced the previous 2002 Regulations. The ‘Managing and Working with Asbestos’ Control of Asbestos Regulations 2012 (“the Regulations”) consolidate two previous ACOPs: L143 “Work with materials containing asbestos”, and L127 “The management of asbestos in non-domestic premises”.

The Regulations provide guidance for employers regarding work which disturbs, or is likely to disturb; asbestos; asbestos sampling; and laboratory analysis. Further, it also provides guidance on the specific duty to manage asbestos on the owners and/or those responsible for maintenance in domestic premises.
